Terms of Use

These Terms of Use ("Terms") apply to comiccollectorscanada.com (the "Site"), operated by Avipol Ventures Inc. ("Comic Collectors Canada", "we", "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. What the Site does

Comic Collectors Canada is a free directory and search tool for Canadian comic collectors. The Site provides:

• a directory of Canadian comic book stores, both in-person and online;
• an events calendar of Canadian comic conventions and shows, including events submitted by the public;
• Find Comics, a tool that searches publicly available product listings on Canadian comic store websites;
• comic news from other publications and from us; and
• an email newsletter you can choose to join.

You do not need an account to use the Site. We are not a retailer. We do not sell comics, take payments or take part in any purchase you make.

2. Store directory

Store details such as hours, addresses, contact information and specialties come from public sources and from the stores themselves. They can change without notice. Please confirm details with the store before you visit. A store being listed does not mean we endorse it.

The directory is not a complete list of comic stores in Canada. A store not being listed, or not being searchable in Find Comics, says nothing about that store.

Store owners can ask us to add, correct or remove a listing by emailing info@comiccollectorscanada.com. Anyone can also use "Suggest a correction" on a listing.

Anyone can suggest a store using "Submit your store". If you submit a store, you confirm that the information is accurate to the best of your knowledge. Every submission is reviewed before it is published, and we may check, complete, edit or decline it at our discretion. By submitting, you allow us to publish the store's details on the Site.

3. Find Comics

When you search, our server checks the public websites of participating Canadian stores and a comic information service (ComicVine), then shows you what it finds. Results are provided as is:

• prices, stock and product details come from the stores and may be out of date, incomplete or wrong;
• we do not guarantee that any item is available or correctly described; and
• any purchase you make is between you and the store, under that store's own terms.

Find Comics only searches stores whose websites we can read automatically. Some stores can't be included, and results may miss items a store has in stock.

If you switch on "Include eBay.ca listings", we also show listings from Canadian sellers on eBay.ca, supplied by eBay. Links to eBay are affiliate links: as a member of the eBay Partner Network, we may earn a commission if you buy after clicking one, at no extra cost to you. This does not change which store or eBay results we show or the order they appear in. Purchases on eBay are between you and the seller and are covered by eBay's User Agreement and policies.

To keep the tool working for everyone, we limit how many searches can be made in a short time. Do not use automated tools to send searches or to copy results from the Site.

4. Events and event submissions

Event listings come from organizers, from the public and from public sources. We do not organize, run or supervise any listed event. Dates, venues and details can change, so confirm them with the organizer before you go. You attend any event at your own risk.

If you submit an event, you confirm that:

• the information is accurate to the best of your knowledge;
• the event is real and comic-related; and
• any website you include belongs to the event or its organizer.

Every submission is reviewed before it is published. We may edit, decline or remove any submission at our discretion. By submitting, you allow us to publish the event details on the Site and in our newsletter.

5. News and advertising

News articles from other publications are shown as a headline, a short summary and a link to the original; they belong to their publishers. Advertisements on the Site are provided by advertisers, and we are not responsible for their products or services.

6. Newsletter

If you subscribe, you agree to receive occasional emails from us about Canadian comic events, stores and collecting. Every email includes a way to unsubscribe, and you can unsubscribe at any time. See our Privacy Policy for how we handle your email address.

7. Acceptable use

When using the Site, you agree not to:

• submit false, misleading, spam or offensive content;
• interfere with the Site's operation, security or rate limits, or try to reach areas you are not authorized to use, including the admin area;
• use bots, scrapers or other automated means to access the Site or collect its content; or
• use the Site for anything unlawful.

We may block access by anyone who breaks these rules.

8. Intellectual property

The Comic Collectors Canada name, logo, site design and original content belong to us. Do not use them without our written permission. Comic titles, characters and cover images belong to their publishers and creators. Store names and logos belong to their owners. Comic information and cover images in search results are provided by ComicVine and the stores.

9. Links to other websites

The Site links to store websites, event websites, news sites and other third-party sites. We do not control them and are not responsible for their content, products, privacy practices or terms.

10. Disclaimer

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND ACCURACY. We do not guarantee that the Site will be available, uninterrupted or error-free.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COMIC COLLECTORS CANADA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. THIS INCLUDES LOSSES FROM RELYING ON STORE, PRICE OR EVENT INFORMATION, OR FROM DEALINGS WITH ANY STORE OR EVENT ORGANIZER. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED CAD $100. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

12. Indemnity

You agree to indemnify and hold harmless Comic Collectors Canada and its owners and contractors from claims arising from your misuse of the Site, content you submit or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be resolved in the courts of Ontario, unless the law of your province gives you the right to bring proceedings where you live.

14. Changes

We may update these Terms from time to time. We will post the new version on this page with a new effective date. If you keep using the Site after a change, you accept the updated Terms.
